THE PROTECTION OF INTELLECTUAL PROPERTY AND CREATIVE ECONOMY

Abstract

At present, the Thai Government has focused on the concept of creative economy and applied this concept to the national social and economic development policy. The new economy is based on the utilization of intangible property (known as intellectual property) to add the value of product and service from the creative industries for example a music industry, a movie industry and the Thai traditional medicine. The appropriate protection and management of intellectual property are important for the creative economy. At this moment, in Thailand the intellectual property system concentrates on the protection and enforcement of intellectual property rights (IPRs) more than the creation and utilization of IPRs. Therefore, the Thai Government should balance among the creation, protection, utilization and enforcement of IPRs. In particular, the government should have the clear policy and strategy of the utilization of IPRs and provides the support programs for creating the effective intellectual property management of government and private sectors both in organization and national level that will be benefit to the social and economic development as a whole.
