The Problems of the Enforcement of Environmental Law Related to Air Pollution in Muang District, Chiang Rai Province

Abstract

This research paper has purposed to study the problems of the law enforcement related to air pollution in Muang District, Chiang Rai Province.

According to the research we have found that there are three main sources of the air pollution in Chiang Rai Province such as the industrial sector, the vehicles and the open air burning. It has been found that the open air burning is the direct cause of the problem.

In the law enforcement part, we have found that there are many laws related to pollution control assign the local administrative organization to provide the regulation to resolve the problems but the thread is the local administrative organization did not provide such regulation because the lack of knowledge, personells and budget that lead to the inefficient of law enforcement. The prospects of those problems may be solved by the make a new law or policy that provide the clear form of the use of power local administrative officer and harmonize the related law or there are need to establish the special organization that include the officer of the central and local administrative organization to resolve the lack of personell problems, the knowledge and the budget in local administrative organization and report the operation result to central administrative organization to assess. That is the real efficiency law enforcement prospect.
