The Liability on Defect of Goods

Abstract

Each country does have provisions on defect of goods. Thai law on this matter is dated for Articles 472-479 of the C.C.C. let the buyer under protected

The study reveals that the buyer should be protected when the goods is not defective per se but unsuitable to the aimed application. It should also come in a proper package to allow better protection. And it should also include a proper instruction and a proper warning if the goods is an dangerous item by nature. Guidance on correct use and other due details must also be included. For hidden defect, the vendor should stay liable for a certain period of time. Contractual exemption or limitation of liability on defective goods should be forbidden.

The author proposes revision of Article 472 of the C.C.C. to reflect the above discussed areas.
