The principle of environmental justice for compensation proposals : The water diversion case in Thailand

Abstract

Environmental justice is all that is coupled with the democratic rights and freedom for people under the Constitution. Hence, everyone shall be treated fairly and non-discriminatorily regardless of race, color, national origin, or income with respect to the development, implementation, and enforcement of environmental laws, regulations, and policies. The public would benefit from better environmental quality and access to decision-making activities in order to have good health as a human being in society equally. The diversion of water from flooding problems regularly occurs because of climate change and global warming while the rainfall situation is the same. Also, the condition of the terrain has been changed due to human exploitation of natural resources causing flood. A measure to relief such problem is the water diversion. Although, the Constitution as the supreme law of the land recognizes the equality principle and environmental principles, undeniably at present the liberal world has led to the different and unequal treatment. It is, thus, difficult to answer where justice is.
