Abstract

The Constitution of the Kingdom of Thailand B.E. 2550 provides the outstanding principle by allowing the people to participate in an administration and inspection of the exercise of State Power. However, having considered the Constitution of the Kingdom of Thailand B.E. 2550 in detail, we should also consider the importance of exercising power by inspecting the regulations of the National Counter Corruption Commission. This mandate is not covered by Chapter 12, regarding the Inspection of the Exercise of the State Power. It, thus, causes some problems of exercising the law. Therefore, the National Counter Corruption Commission should either be removed from the office of power or the National Counter corruption Commission should monitor their exercise of power, etc. As a result, the researcher proposes the process of inspection of the exercise of power of the National Counter Corruption Commission, specially the declaration of assets and liabilities of political position holders and other state officials, removal from offices and criminal proceeding against persons holding political positions, including other problems concerned, which considered from the Constitutions and the relative laws by comparison with the process of inspection of the exercise of the State Power in accordance with the Constitution of the Kingdom of Thailand B.E. 2550, Chapter 12, regarding the Inspection of the Exercise of the State Power. From this research, it can be understood that the process of the inspection of the exercise of power of the National Counter Corruption Commission, and also regarded the problems of implementation as well as the solution of the problems. Furthermore, it should follow and inspect the implementation of the National Counter Corruption Commission more effectively and fruitfully, it should be promoted and supported by the participation of the people at all levels in order to monitoring the exercise of State Power, in accordance with the principle of the Constitution of the Kingdom of Thailand B.E. 2550.
