บทคัดย่อ

กฎหมายกีฬาเป็นระบบกฎหมายเอกชน ที่มีมาจากสามแหล่งหลัก ประกอบด้วยกฎ ข้อบับคับ และประเพณีทางกีฬา คาตัดสินชี้ขาดข้อพิพาทขององค์การกีฬาโอลิมปิค คาวินิจฉัยชี้ขาดของศาลกีฬาโลก และหลักกฎหมายระหว่างประเทศทั่วไปในทางกีฬา กฎหมายกีฬาเป็นระบบกฎหมายที่ใช้ภายในประชาคมกีฬาโลก ด้วยอานาจที่เป็นอิสระของกฎหมายกีฬาทาให้องค์การกีฬามีอานาจปกครองตนเอง โดยมีกฎหมายกีฬาเป็นเครื่องมือป้องกันการแทรกแซงจากอานาจจากองค์การภายนอกในการใช้ ตีความ แก้ไข เปลี่ยนแปลงกฎระเบียบกีฬา การคัดเลือกผู้นากีฬา และรูปแบบการปกครองขององค์กรกีฬา

ABSTRACT

Sports law is recognized as private law system. Sports law deriving from several sources including the rules, regulations and customs of sport (Lex Ludica), the jurisprudence of the Olympic Games (Lex Olympica), jurisprudence of Court of Arbitration of Sport (Lex Sportiva) and principles international law in sport (JusCommune). Sport law is a body of rules governing the practice of sport and resolution of disputes in sport. Autonomy of sports law creates autonomy of international sport organizations because the law provides sporting competences including the ability of international sports governing bodies, without undue external influence, to establish, amend and interpret sporting rules, to select sporting leaders and governance styles.
