ภูมิปัญญาท้องถิ่นด้านการแสดงออกทางศิลปวัฒนธรรมดั้งเดิมจัดเป็นทรัพย์สินทางปัญญา  ที่สามารถสร้างประโยชน์ในเชิงพาณิชย์ได้อย่างมหาศาล จึงพยายามผลักดันให้เกิดความคุ้มครอง ซึ่งปัจจุบันยังไม่มีกฎหมายฉบับใดที่จะให้ความคุ้มครองภูมิปัญญาท้องถิ่นด้านการแสดงออกทางศิลปวัฒนธรรมดั้งเดิมโดยตรงได้ มีเพียงกฎหมายที่มีความคาบเกี่ยวกับการให้ความคุ้มครองภูมิปัญญาท้องถิ่นด้านการแสดงออกทางศิลปวัฒนธรรมดั้งเดิมเท่านั้น การศึกษาครั้งนี้มีวัตถุประสงค์เพื่อศึกษาความเป็นมา แนวคิดและทฤษฎีเกี่ยวกับภูมิปัญญาท้องถิ่นด้านการแสดงออกทางศิลปวัฒนธรรมดั้งเดิม ศึกษากฎหมายที่มีความคาบเกี่ยวและปัญหาในการให้ความคุ้มครองภูมิปัญญาท้องถิ่นด้านการแสดงออกทางศิลปวัฒนธรรมดั้งเดิม รวมถึงศึกษาแนวทางในการให้ความคุ้มครองภูมิปัญญาท้องถิ่นด้านการแสดงออกทางศิลปวัฒนธรรมดั้งเดิมของประเทศไทย จากการศึกษาพบว่า มีปัญหาความเป็นวัตถุแห่งสิทธิที่ไม่อาจนำมาบังคับใช้กับภูมิปัญญาท้องถิ่นด้านการแสดงออกทางศิลปวัฒนธรรมดั้งเดิมได้อย่างครอบคลุม ทั้งจากลักษณะและประเภทของภูมิปัญญาท้องถิ่นด้านการแสดงออกทางศิลปวัฒนธรรมดั้งเดิมนั้นไม่สามารถเข้าเงื่อนไขตามที่กฎหมายกำหนดไว้ รวมไปถึงปัญหาผู้มีสิทธิใช้ที่ไม่ได้ระบุการให้ความคุ้มครองแก่ชุมชนท้องถิ่นผู้ถือครองภูมิปัญญาท้องถิ่นด้านการแสดงออกทางศิลปวัฒนธรรมดั้งเดิมนั้นๆ ดังนั้น ผู้ศึกษาจึงเสนอให้มีการตรากฎหมายเฉพาะอันเป็นมาตรการในการคุ้มครองทรัพย์สินทางปัญญาเพื่อให้ความคุ้มครองกับภูมิปัญญาท้องถิ่นด้านการแสดงออกทางศิลปวัฒนธรรมดั้งเดิม

Abstract

Traditional Cultural Expression is an intellectual property that can generate enormous commercial benefits, so there are attempts to preserve and protect it. Nowadays, there are not any measures or laws that provide direct protection to Traditional Cultural Expression, however there are a few laws that overlap to the protection to Traditional Cultural Expression. The purpose of this research is to study the origin, concepts, and theories of Traditional Cultural Expression. Moreover, the laws that overlapped the protection to Traditional Cultural Expression and problems in the protection would be studied. It is also Including the study of guidelines for the protection to Traditional Cultural Expression in Thailand. According to this study, there is a problem of subject matter that cannot applied to the Traditional Cultural Expression. The characteristics and types of Traditional Cultural Expression could not meet the qualification required by the law. In addition, the problem of the right holder does not  specify the protection to local community as the person holding the Traditional Cultural Expression. Therefore, the researcher suggested to legislate specific intellectual property law to protect the Traditional Cultural Expression.
