บทคัดย่อ

          การค้าประเวณีในประเทศไทยเป็นอาชีพที่ผิดกฎหมายตั้งแต่ปีพ.ศ.2503 แม้ภายหลังจะมีการออกกฎหมายมาเพื่อปราบปรามการค้าประเวณีรวมถึงแก้ไขปัญหาการค้ามนุษย์แต่หาทำให้การค้าประเวณีในประเทศไทยลดน้อยลงแต่อย่างใด จากการศึกษาถึงที่มาของปัญหาส่วนหนึ่งมาจากความต้องการทางเพศของมนุษย์ประกอบกับสังคมทุนนิยมที่บุคคลบางกลุ่มเลือกจะประกอบอาชีพนี้เนื่องจากง่ายต่อการสร้างรายได้รวมไปถึงชื่อเสียงด้านการค้าบริการทางเพศนั้นเป็นที่รู้จักกันดีในสายตาของชาวต่างชาติ อีกทั้งการบังคับใช้กฎหมายจากเจ้าหน้าที่รัฐบางส่วนยังมีความบกพร่อง ไม่ปฏิบัติตามกฎหมาย ไร้ซึ่งประสิทธิภาพในการบังคับใช้ สาเหตุนั้นมาจากเจ้าหน้าที่รัฐบางหน่วยงานเกิดกระทำการทุจริตต่ออำนาจหน้าที่ของตนเพื่อผลประโยชน์ที่ได้รับจากการลักลอบค้าประเวณี ปัญหาจากตัวกฎหมายและจากการบังคับใช้กฎหมายอย่างไม่จริงจังจึงส่งผลกระทบแก่บุคคล 3 กลุ่มที่เกี่ยวข้องกับการค้าประเวณี คือ ผู้ค้าประเวณี ผู้ประกอบการค้าประเวณี และผู้ดำรงชีพจากรายได้ของผู้ค้าประเวณี ซึ่งทั้งสามกลุ่มนี้มีความสำคัญอย่างมากต่อการค้าประเวณีในประเทศไทย

          ดังนั้น ผู้เขียนจึงมีความต้องการศึกษาปัญหาของมาตรการทางกฎหมายในการควบคุมการค้าประเวณีเพื่อหาทางออกให้กับปัญหานี้และมีข้อเสนอแนะว่า ควรมีการแก้ไขกฎหมายในการการควบคุมการค้าประเวณีของประเทศไทยให้ถูกต้องตามกฎหมาย โดยมีหลักเกณฑ์ ข้อบังคับ ระเบียบต่างๆที่ผู้ที่เกี่ยวข้องกับการ ค้าประเวณีสามารถปฏิบัติตามได้  มีการกำหนดอัตราโทษที่สูงขึ้นแก่ผู้ที่ฝ่าฝืนกฎหมายรวมไปถึงบทลงโทษที่จริงจังแก่เจ้าหน้าที่รัฐบางส่วนที่ไม่บังคับใช้กฎหมายอย่างเข้มงวด หรือทุจริตต่ออำนาจหน้าที่ของตนเพื่อเปิดโอกาสให้มีการลักลอบการค้าประเวณีที่ผิดกฎหมาย ทั้งนี้เพื่อเป็นการยกระดับการจัดการของเจ้าหน้าที่รัฐให้มีประสิทธิภาพรวมไปถึงแก้ไขปัญหาจากการค้าประเวณีที่สะสมมาอย่างยาวนานในสังคม

Abstract

           The prostitution in Thailand has been an illegal occupation since 1960. Although subsequent legislation has been enacted to suppress prostitution, including resolving human trafficking, it did not decrease the prostitution in Thailand. Due to human sexual desire, coupled with the capitalism society that people choose to pursue in this profession because it is an easy way to make money as well as the sex industry is well known to foreigners. Law enforcement by some government officials is still defective and ineffective. The reasons are legal issues and some government officials have committed fraud against their duties for the benefit of illegal prostitution which is causing to affect three groups of people who are involved in the prostitution which are prostitutes, brothel-keeper, and pimps. These three groups are very important to sex industry in Thailand.

          Therefore, the author would like to study the problems of legislative measures concerning with the control of prostitution in order to find a solution to this problem and suggests that there should be a law to regulate and control the prostitution in Thailand to be legal following with the rules, regulations that involved in prostitution. Moreover, imposing higher the penalties for those who violate the law, including serious penalties for some government officials that do not strictly enforce laws or fraud to their authority in order to allow illegal prostitution. Accordingly, to enhance the management of government officials to be effective and to solve problems from prostitution that has accumulated for a long time in Thailand.
