บทคัดย่อ

          ปัจจุบันการกระทำความผิดทางอาญาของเด็กและเยาวชนในประเทศไทยมีสถิติที่สูงขึ้น จากการศึกษาพบว่าการกระทำความผิดเหล่านั้นมีลักษณะร้ายแรงไม่ต่างจากการกระทำความผิดของผู้กระทำความผิดที่เป็นผู้ใหญ่ โดยเฉพาะอย่างยิ่งในฐานความผิดตามประมวลกฎหมายอาญาลักษณะ 9 ความผิดเกี่ยวกับเพศว่าด้วยการข่มขืนกระทำชำเรา ซึ่งบทความนี้มีการศึกษาถึงแนวคิดการลงโทษเด็กและเยาวชนในประเทศไทยและแนวคิดการลงโทษให้ได้สัดส่วนตามทฤษฎี Just Deserts ที่ในต่างประเทศนำมาปรับใช้กับเด็กและเยาวชนที่กระทำความผิดอาญาในฐานความผิดร้ายแรงว่ามีเงื่อนไขหรือข้อพิจารณาทางกฎหมายอย่างไรและมีความเหมาะสมกับบริบทสังคมปัจจุบันหรือไม่

จากการศึกษาพบว่า แนวคิดการลงโทษเด็กและเยาวชนในประเทศไทยอยู่บนพื้นฐานการลงโทษเพื่อแก้ไขฟื้นฟูซึ่งเป็นแนวคิดที่ใช้มาอย่างยาวนาน ตามบทบัญญัติในประมวลกฎหมายอาญามาตรา 73-75 ไม่ว่าการกระทำความผิดนั้นจะเป็นการกระทำความผิดฐานใดหรือมีลักษณะรุนแรงเพียงใดย่อมได้รับการยกเว้นโทษหรือลดโทษเสมอ ซึ่งไม่ทำให้การกระทำความผิดของเด็กและเยาวชนลดลง แต่ในต่างประเทศที่มีการใช้ทฤษฎี Just Deserts กลับพบสถิติการกระทำความผิดทางอาญาของเด็กและเยาวชนลดลง ดังนั้นประเทศไทยจึงควรมีการเปลี่ยนแปลงรูปแบบการลงโทษเด็กและเยาวชน โดยนำแนวคิดการลงโทษตามทฤษฎี Just Deserts มาบังคับใช้กับฐานความผิดเกี่ยวกับเพศว่าด้วยการข่มขืนกระทำชำเราที่มีลักษณะร้ายแรง เนื่องจากมีความเหมาะสมกับเด็กและเยาวชนในยุคปัจจุบัน

Abstract

The number of crimes committed by young people in Thailand is increasing. It was found that those crimes are as serious as the crimes committed by adults, especially for the crimes of rapes under the type 9 of the criminal code. This article studied the guidelines for punishing the young people in Thailand and the concepts of proportional punishments according to the theory of just deserts that is applied to the young people committing serious crimes in other countries by considering legal conditions and social contexts.

It was found that punishing the young people in Thailand was based on restoration. This concept has been used for a long time. According to the sections 73 – 75 of the criminal code, any punishment for any offense may be exempted or mitigated regardless of the seriousness of the offense without mitigating the offense which does not reduce the number of offenses committed by young persons. In other countries applying the theory of just deserts, the number of the crimes committed by young people is reduced. Therefore, Thailand should amend the punishments for the young people by applying the theory to the serious crimes of rapes since it is appropriate for modern people.
