บทคัดย่อ

บทความนี้มีวัตถุประสงค์เพื่อศึกษาในเรื่องขององค์กรอัยการที่เกี่ยวข้องกับกฎหมายวิธีพิจารณาคดีอาญาที่ได้กาหนดไว้ในระเบียบสำนักงานอัยการสูงสุดว่าด้วยการดำเนินคดีอาญาของพนักงานอัยการ พ.ศ.2547 และระเบียบสำนักงานอัยการสูงสุดว่าด้วยการดำเนินคดีอาญาชั้นศาลสูงของพนักงานอัยการ พ.ศ. 2556 ในส่วนของการสั่งคดีของพนักงานอัยการกรณีสิทธิฟ้องคดีอาญาระงับและคำสั่งของพนักงานอัยการในเรื่องดังกล่าว ซึ่งในทางปฏิบัติพนักงานอัยการมักเกิดข้อสงสัยและอาจเกิดความสับสนถึงที่มาและเหตุผลของการออกกฎโดยที่ประมวลกฎหมายวิธีพิจารณาความอาญาไม่มีบทบัญญัติให้อำนาจพนักงานอัยการออกคาสั่งในเรื่องนี้ได้ ทำให้คำสั่งของพนักงานอัยการในเรื่องนี้ขาดการถูกตรวจสอบถ่วงดุลอำนาจจากหน่วยงานอื่น

ผู้เขียนได้รวบรวมกฎหมายสาคัญที่เกี่ยวข้องกับการดำเนินคดีอาญาของพนักงานอัยการไว้ และศึกษาค้นคว้าถึงที่มาและเหตุผลในการออกกฎจากกฎหมายต่างประเทศ นำมาวิเคราะห์กับการปฏิบัติงานและนำเสนอในมุมมองและแง่คิดตามหลักกฎหมายปกครอง

บทความนี้ผู้เขียนคาดว่าน่าจะทำให้องค์กรอัยการหยิบยกปัญหาในเรื่องดังกล่าวขึ้นพิจารณาและกำหนดแนวทางการออกคำสั่งกรณีสิทธิฟ้องคดีอาญาระงับให้สอดคล้องกับประมวลกฎหมายวิธีพิจารณาความอาญาตลอดจนการแก้ไขระเบียบสำนักงานอัยการสูงสุดว่าด้วยการดำเนินคดีอาญาและการดำเนินคดีอาญาชั้นศาลสูงของพนักงานอัยการในเรื่องการออกคำสั่งกรณีสิทธิฟ้องคดีอาญาระงับในบางเรื่องที่ไม่ขัดต่อประมวลกฎหมายวิธีพิจารณาความอาญาไว้ให้ชัดเจน

Abstract

The objective of this article is to study the role of the Public Prosecution Organ under the Regulations of the Office of the Attorney General re: the Public Prosecutor’s Criminal Proceedings B.E. 2547 and the Regulations of the Office of the Attorney General re: Public Prosecutor’s Criminal Proceedings in the Appellate Court Level B.E. 2556, concerning a public prosecutor’s order in a case where the right to prosecute is terminated. In practice, public prosecutors have doubts about the basis for issuing a termination order, because the Criminal Procedure Code does not empower them to do so. As such, any public prosecutor’s order lacks proper scrutiny by other agencies.

The author compiled the relevant legislation relating to the conduct of criminal proceedings and conducted research on the background and legal rationale underlying this matter based on foreign legal sources. The author then carried out an analysis and presented his findings from an administrative law perspective.

It is anticipated that the Public Prosecution Organ will consider this matter and provide guidelines for the issuing of orders in cases where the right to prosecute is terminated in accordance with the Criminal Procedure Code, and will also suggest amendments to some parts of the Regulations of the Office of the Attorney General re: the Public Prosecutor’s Criminal Proceedings B.E. 2547 and the Regulations of the Office of the Attorney General re: Public Prosecutor’s Criminal Proceedings in the Appellate Court Level B.E. 2556 relating to the termination of a prosecution to ensure that such guidelines and amendments are compatible with the Criminal Procedure Code.
