บทความนี้เป็นการศึกษาวิเคราะห์ว่าสิทธิครอบครองในที่ดินที่อยู่ในเขตปฏิรูปที่ดิน หรือที่เรียกว่า ส.ป.ก. มีได้หรือไม่ ตลอดจนการเกิดขึ้นของสิทธิครอบครอง และองค์ประกอบของสิทธิครอบครอง สิทธิครอบครองในทางแพ่งและทางอาญามีความแตกต่างกันหรือไม่ อย่างไร อันจะส่งผลต่อการทำความเข้าใจและปรับใช้กับที่ดินที่อยู่ในเขตปฏิรูปที่ดินด้วยเช่นกัน อีกทั้งยังศึกษาไปถึงแนวคำพิพากษาศาลฎีกาเกี่ยวกับสิทธิครอบครองในเขตปฏิรูปที่ดินและที่เกี่ยวข้องไว้อย่างไร

Abstract

The article aims to study and analyze a person’s possessory right to acquire a plot of land in agricultural land reform or Sor Por Kor land, including the occurrence, the important natures, the elements and how different between civil and criminal of possessory right in order to understand and apply on a plot of land in land reform area. The Supreme Court decisions will also discuss in this article for further details in the right of possession in Agricultural reform.
