บทความนี้เป็นการศึกษาที่มีวัตถุประสงค์เพื่อทราบความเป็นมาของผลงานที่ถือเป็นการสืบสานงาน
ศิลปกรรมแบบไทยโบราณที่เรียกว่า “ตุ๊กตาชาววัง” ในฐานะเป็นภูมิปัญญาท้องถิ่นของไทย และเพื่อทราบ ความหมาย ความส าคัญ ลักษณะ ประเภทของภูมิปัญญาท้องถิ่น และกฎหมายที่ให้ความคุ้มครองแก่ผลงาน “ตุ๊กตาชาววัง” จากการศึกษาพบว่า ตุ๊กตาชาววังถูกริเริ่มขึ้นในสมัยรัชกาลที่ห้า และต่อมาได้มีการฟื้นฟูขึ้น ตามแนวพระราชด าริของสมเด็จพระนางเจ้าฯ พระบรมราชินีนาถ ในพระบาทสมเด็จพระปรมิทร มหาภูมิพลอดุลยเดช จนกระทั่งมีการจัดตั้งศูนย์ตุ๊กตาชาววังบ้านบางเสด็จ ตุ๊กตาชาววังเป็นผลงานการ สร้างสรรค์ทางปัญญาของคนในชุมชนบางเสด็จที่แสดงออกมาในลักษณะของงานศิลปกรรม ที่สะท้อนให้เห็น ถึงวัฒนธรรม ความเป็นอยู่ และวิถีชีวิตของคนไทยในอดีต ผลงาน “ตุ๊กตาชาววัง” จึงเป็นผลงานที่ควรได้รับ ความคุ้มครองเพื่อสืบทอดเป็นมรดกทางวัฒนธรรมและส่งเสริมเศรษฐกิจในชุมชน แต่จากการศึกษาการ คุ้มครองพบว่า “ตุ๊กตาชาววัง” เป็นผลงานภูมิปัญญาท้องถิ่นที่ยังไม่มีกฎหมายคุ้มครองภูมิปัญญาท้องถิ่นเป็น การเฉพาะ และเมื่อพิจารณากฎหมายทรัพย์สินทางปัญญาที่มีอยู่ก็ไม่สามารถให้ความคุ้มครองแก่ผลงาน “ตุ๊กตาชาววัง” ได้ ดังนั้น จึงควรมีนโยบายและมาตรการทางกฎหมายส าหรับการคุ้มครองผลงานภูมิปัญญา ท้องถิ่น เพื่อให้ชุมชนบางเสด็จผู้ผลิตผลงาน “ตุ๊กตาชาววัง” ได้รับการคุ้มครองตามกฎหมาย อันจะเป็น ประโยชน์ต่อการสืบสานวัฒนธรรม วิถีไทยในแบบของงานศิลปกรรมไทยต่อไป 

Abstract

The purpose of this article is to study the origin of “Court Doll”, a traditional Thai arts and local wisdom, and to understand the meaning, significance, type of local wisdom and legal protection. According to the study, it is found that the court doll was created during the reign of King Rama V and later it has been recreated under the royal initiation of Her Majesty the Queen Sirikit. Consequently Ban Bang Sadet Court Doll Center was founded. The court doll is a creative art works of people in Bang Sadet community, which reflects culture, livelihood and way of life of Thai people in the past. The “Court Doll”, therefore, should become an artwork which requires protection for a cultural heritage and the community’s
economic support. However, regarding the study, the “Court Doll” has not been protected by law. Considering from the present intellectual property law, it cannot protect this artworks. In consequence, there should be policy or legal measurement to protect the works of local wisdom for Bang Sadet community who is the creator of the court doll. This will benefit to hand down Thai cultural and living arts to the future.
