บทคัดย่อ
การริเริ่มเสนอร่างกฎหมายโดยประชาชนนับเป็นสิทธิของประชาชนในการมีส่วนร่วมทางการเมือง เนื่องจากการแสดงบทบาทอำนาจหน้าที่ของผู้แทนมีข้อจำกัดและอาจไม่สอดคล้องหรือไม่สนองตอบต่อความต้องการของประชาชนได้อย่างครบถ้วน ในระยะเวลา 20 ปีนับแต่รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2540 ได้เปิดพื้นที่ให้ภาคประชาชนเข้ามามีส่วนร่วมทางการเมืองก่อให้เกิดความตื่นตัวในการมีส่วนร่วมทางการเมืองของภาคประชาชนอันรวมถึงการเสนอร่างพระราชบัญญัติของภาคประชาชนที่ถูกนำเสนอต่อรัฐสภามีจำนวนมากขึ้น ทว่า การมีส่วนร่วมดังกล่าวยังคงมีอุปสรรคอยู่บางประการตลอดระยะเวลาที่ผ่านมาอาทิ เอกสารที่ต้องใช้ การรวบรวมรายชื่อ การยกร่างกฎหมาย และค่าใช้จ่าย ดังนั้น จึงสมควรปรับปรุงกระบวนการดังกล่าวภายใต้แนวคิดการปฏิรูปตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 เพื่อให้เกิดกระบวนการเข้าชื่อเสนอกฎหมายที่เหมาะสมสำหรับภาคประชาชนต่อไป

Abstract
People’s legal initiative is a right to participate in politics due to a limitation of representative’s authorities. Therefore, the needs of people may not be responded properly. Within the past two decades, the promulgation of the Constitution of the Kingdom of Thailand B.E. 2540 created political attentiveness to the Thai people including legal initiative as evidence in numbers of draft laws have been submitted to the parliament increasingly.However, there were some obstacles along the process in the past for instance required documents, collecting name list, drafting bill, and expenses. Hence, the initiative process should be reformed under the philosophy of the Constitution of the Kingdom of Thailand B.E. 2560.
