บทคัดย่อ

ตั้งแต่ค.ศ.1999 การพัฒนาในความหมายขององค์การสหประชาชาติไม่จำกัดเพียงการพัฒนาทางเศรษฐกิจแต่กำหนดตัวชี้วัดการพัฒนาโดยใช้วัฒนธรรมเป็นตัวสิ่งบ่งชี้ เพราะวัฒนธรรมมีบทบาทต่อการพัฒนาด้านการเมือง เศรษฐกิจ และสังคม คุณค่าของวัฒนธรรมเป็นทุนต่อการพัฒนาประเทศ รวมทั้งทุนวัฒนธรรมไม่อาจจับต้องได้ เช่น คำสั่งสอน คติความเชื่อ ประเพณีซึ่งถ่ายทอดภายในครอบครัวและชุมชน สามารถรับรู้ได้โดยการแสดงออกในสังคมหรือจากมรดกทางวัฒนธรรมที่เป็นความภาคภูมิใจ อันมีหลักฐานแห่งวัฒนธรรมในรูปแบบทรัพย์สินทางวัฒนธรรม และมรดกภูมิปัญญาทางวัฒนธรรม มาตรการทางกฎหมายเพื่อส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรมถูกพัฒนาขึ้นโดยองค์การยูเนสโกภายใต้กรอบความร่วมมือระหว่างประเทศสำคัญ คือ อนุสัญญาว่าด้วยการสงวนรักษามรดกวัฒนธรรมที่จับต้องไม่ได้ ค.ศ.2003 ซึ่งมีอิทธิพลต่อการพัฒนากฎหมายของประเทศไทยในฐานะสมาชิกของประชาคมระหว่างประเทศ โดยประการใช้พระราชบัญญัติส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรม พ.ศ.2559 และภาคยานุวัติเป็นภาคีของอนุสัญญา กระนั้น อุปสรรคสำคัญของกฎหมายฉบับนี้ คือ ลักษณะกฎหมายว่าด้วยวัฒนธรรมภายใต้กระแสชาตินิยมส่งผลให้องค์กรตามพระราชบัญญัติมีลักษณะจากรัฐบาลสู่ท้องถิ่นมากกว่าการส่งเสริมให้ท้องถิ่นมีบทบาทตามเจตนารมย์ของกฎหมายระหว่างประเทศ ประเทศไทยยังมีกฎหมายและหน่วยงานกำกับดูแลมรดกภูมิปัญญาทางวัฒนธรรมในลักษณะเฉพาะ พระราชบัญญัติส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรมจึงยังจำต้องถูกพัฒนาทั้งความสอดคล้องในบริบทของกฎหมายระหว่างประเทศ และบริบททางการเมือง เศรษฐกิจ และสังคมของประเทศไทยเพื่อให้กฎหมายฉบับนี้เกิดประโยชน์อย่างแท้จริง

Abstract

Since 1999, Development has been defined by United Nations to be wider than economic development indicator. It includes cultural development indicator because culture affects politics, economy, and society of all countries. Cultural value is capital to develop states as known as cultural capital. Intangible culture has been defined as Intangible cultural capital, such as precept, folklore, tradition etc., which has propagated in family, tribe and community, from generation to generation. They are acknowledged by express performance or having self-esteem in cultural heritage. Cultural property and Intangible cultural heritage (ICH) have been considered to be cultural property by meaning. Legal measures to promote and safeguard ICH has been developed by an international conventions of United Nations Educational, Scientific and Cultural Organization-UNESCO that is evaluated to the Convention for the Safeguarding of the Intangible Cultural Heritage in 2003. Thailand has been a party by accession in 2016 and has enacted Preservation and Protection of Intangible Cultural Heritage Act B.E.2559. Although Thailand has developed domestic law in accordance with international convention, but the law is obstacle to enforce because, firstly, the act empowers the government more than traditional communities to register ICH. This is inconsistent to the intention of convention. Secondly, authorized agencies and other acts are not in unity. The act should be developed to become consistent to international wills and domestic context to be productive to politic, economy and society of Thailand.
