Abstract

การศึกษาวิจัยในครั้งนี้ มีวัตถุประสงค์ เพื่อศึกษาปัญหากฎหมายอุทยานแห่งชาติที่กระทบต่อสิทธิชุมชนของชาวเล ซึ่งมีเพียง 2 ประการที่เกี่ยวข้อง คือ ประการแรกเกี่ยวกับปัญหาชาวเลถูกจับกุมจากการทาประมงด้วยวิถีดั้งเดิม และประการที่สองเกี่ยวกับปัญหาที่ชาวเลไม่มีสิทธิในที่ดินเพื่ออยู่อาศัยและถูกขัดขวางมิให้ประกอบพิธีกรรมดั้งเดิมในเขตพื้นที่ถูกประกาศให้เป็นพื้นที่อุทยานแห่งชาติ โดยการศึกษากฎหมายระหว่างประเทศ กฎหมายของต่างประเทศ ตลอดจนกฎหมายต่าง ๆของไทย เพื่อปฏิรูปพระราชบัญญัติอุทยานแห่งชาติ พ.ศ. 2504 และเพื่อค้นหามาตรการทางกฎหมายที่เหมาะสมที่จะนามาใช้ในการแก้ปัญหาของการดารงวิถีชีวิตของชาวเลอันเป็นชุมชนท้องถิ่นดั้งเดิมให้สืบไป ควบคู่กับการอนุรักษ์อุทยานแห่งชาติในแถบพื้นที่ทะเลอันดามัน

จากการศึกษาพบว่า กฎหมายระหว่างประเทศกฎหมายของต่างประเทศ ตลอดจนกฎหมายรัฐธรรมนูญของไทยฉบับต่าง ๆ ได้บัญญัติรับรองถึงสิทธิชุมชนท้องถิ่นดั้งเดิมไว้ทั้งสิ้น จึงเห็นควร แก้ไขมาตรา 16 แห่งพระราชบัญญัติอุทยานแห่งชาติ พ.ศ. 2504 ให้มีข้อยกเว้นให้ชาวเลอันเป็นชุมชนท้องถิ่นดั้งเดิมมีสิทธิทากินและอยู่อาศัยในในพื้นที่เขตอุทยานแห่งชาติได้ กล่าวคือ ให้ชาวเล มีสิทธิทาประมง และสามารถถือครองที่ดินได้โดยมีกรรมสิทธิ์ในลักษณะของ การออกโฉนดชุมชน และการจัดตั้งเขตวัฒนาธรรมพิเศษ เพื่ออนุรักษ์วิถีชีวิตชาวเลอันเป็นชุมชนดั้งเดิมให้อยู่คู่กับทะเลอันดามันสืบไป

The objectives of this research were to study the problem of the National Park Act that affects sea gypsies in only 2 related aspects: First is about the problem of the sea gypsies being arrested for traditional fishing and second is the problem of sea gypsies having no Land Rights to live in the land and are prevented from performing the traditional ritual in the area declared a national park area. This is done by studying international law and the laws of Thailand to reform the National Park Act, B.E. 2504 (1961). Additionally, this is to find appropriate legal measures to address the problem of the sea gypsy way of life, which is a local traditional community to continue coupled with the conservation of the national park in the Andaman Sea area.

From the study, it was found that international laws and various Thai constitutional laws guarantee local traditional community rights. Thus, it is deemed that Article 16 of the National Park Act, B.E. 2504 (1961) should be amended by defining the exception for sea gypsies, which is a local traditional community to have the right to perform fishery and to possess land with the ownership in the form of community deed and the establishment of special cultural zones to preserve the sea gypsy traditional life to further exist alongside the Andaman Sea.
