บทคัดย่อ

การวิจัยนี้เป็นการศึกษาสิทธิของประชาชนในการมีส่วนร่วมในการจัดการทรัพยากรประมงชายฝั่ง โดยศึกษากระบวนการและรูปแบบที่เหมาะสมของการมีส่วนร่วมของประชาชนในการจัดการทรัพยากรประมงของชุมชนบ่อบาป ชุมชนท่าเสา และชุมชนหัวเขา อำเภอสิงหนคร จังหวัดสงขลา ในลุ่มน้ำทะเลสาบสงขลา ผลการศึกษาพบอุปสรรคของการที่ประชาชนในชุมชนเข้ามามีส่วนร่วมในการจัดการประมงเนื่องจากชุมชนบ่อบาปและชุมชนท่าเสาทั้งสองชุมชนมีข้อตกลง หรือกติกาของชุมชนในการจัดการประมงชายฝั่งของชุมชนซึ่งเป็นที่รับรู้ในชุมชน แต่ข้อตกลงหรือกติกาของชุมชน เหล่านี้ยังไม่เป็นกฎหมายจึงไม่มีสถานะสามารถใช้บังคับได้ จึงควรปรับปรุงกฎหมายให้แก่องค์กรปกครองส่วนท้องถิ่นกำหนดเป็นข้อบัญญัติรายละเอียดเกี่ยวกับในแบบของการส่งเสริมให้ประชาชนมีสิทธิในการจัดการทรัพยากรประมงให้ชัดเจนอันส่งผลต่อชุมชนให้สามารถดำเนินกิจกรรมการจัดการประมงโดยชุมชนที่แท้จริงต่อไป

ABSTRACT

This study is to research about the rights of people in participating in coastal fisheries management. It is also to study about the process and appropriate prototype of the participation for fisheries resources management. The study was conducted from Bo Barb community, Tha Sou community and Hua Kao community located in Singhanakorn district, Songkhla, Thailand. As a result, the study shows that the obstacle for the participation of people is community agreement which has existed in both Bo Barb community and Tha Sou community, however, it cannot be enforced legally. This is because it has not been enacted accordingly to the laws. Hence, this study suggests that the local government should enact it in order to encourage people to participate in fisheries resources management. This finally leads community to exercise the activities for fisheries resources management.
