ระบบการจดทะเบียนเครื่องหมายการค้าประชาคมเศรษฐกิจอาเซียนจะช่วยแก้ปัญหา ความแตกต่างของกฎหมายเครื่องหมายการค้าในประเทศสมาชิกประชาคมเศรษฐกิจให้อยู่ภายใต้ ระบบที่มีมาตรฐานเดียวกัน ด้วยการจดทะเบียนเครื่องหมายการค้าเพียงทะเบียนเดียว ครั้งเดียว ภาษาเดียว ที่เดียว แต่ให้ความคุ้มครองครอบคลุมทุกประเทศสมาชิกประชาคมเศรษฐกิจอาเซียน อันส่งผลให้เครื่องหมายการค้าได้รับความคุ้มครองที่ครอบคลุมสมบูรณ์มากยิ่งขึ้น นอกเหนือไปจาก การให้ความคุ้มครองเครื่องหมายการค้าตามพิธีสารมาดริด โดยบทความนี้ได้แสดงให้เห็นถึงข้อดี ข้อเสียของระบบการจดทะเบียนเครื่องหมายการค้าประชาคมเศรษฐกิจอาเซียน และปัญหาของการก่อให้เกิดระบบการจดทะเบียน เครื่องหมายการค้าประชาคมเศรษฐกิจอาเซียน ทั้งยังเสนอแนะ แนวทางการแก้ปัญหาเพื่อก่อให้เกิดระบบการจดทะเบียนเครื่องหมายการค้าประชาคมเศรษฐกิจ อาเซียนต่อไปในอนาคต

ABSTRACT

The community trade mark registration system in AEC (ASEAN Economic Community) will solve the problem regarding the different trade mark registration systems of member countries in AEC. The community trade mark requires one single application with one language submitted to a central office. When a mark is registered as a CTM, its effect will extend throughout the entire AEC. The community trade mark will provide the more complete protection to the trade mark owner than Madrid protocol. This article also elaborates the advantages and disadvantages including the problem of creating the community trade mark registration system in AEC. The author also provides recommendations to solve the problems which will enable the community trade mark in AEC can happen in the future.
