ความร่วมมือระหว่างประเทศทางอาญาในการต่อต้าน อาชญกรรมการท่องเที่ยว เพื่อล่วงละเมิดทางเพศเด็กในระดับภูมิภาค

Abstract

The International Cooperation in Criminal Issues in Thailand to Combat the Child Sexual Exploitation in Travel and Tourism -in the Greater Mekong Sub-Region

บทคัดย่อ

บทความนี้เป็นการศึกษาหลักเกณฑ์เกี่ยวกับความร่วมมือระหว่างประเทศทางอาญาของประเทศไทยในการต่อต้านการท่องเที่ยวเพื่อล่วงละเมิดทางเพศเด็กในระดับภูมิภาค ในสี่ประเทศ ได้แก่ ประเทศไทย กัมพูชา  สาธารณรัฐประชาธิปไตยประชาชนลาว และเวียดนาม  เพื่อเสนอแนะกลไกทางกฎหมายและกลไกอื่นๆเพื่อความร่วมมือระหว่างประเทศในการป้องกันและต่อต้านการท่องเที่ยวเพื่อแสวงหาประโยชน์ทางเพศจากเด็ก

จากการศึกษากฎหมายความร่วมมือระหว่างประเทศทางอาญาและกฎหมายการส่งผู้ร้ายข้ามแดนพบสภาพปัญหา คือ ปัญหาขาดการประสานงานของหน่วยงานและความล่าช้าของกระบวนการ ปัญหาเรื่องค่าใช้จ่ายที่สูงเมื่อมีการดำเนินการระหว่างประเทศ ปัญหาข้อกฎหมายและทางปฏิบัติในการส่งผู้ร้ายข้ามแดน การขาดมาตรการในการส่งเสริมความร่วมมือระหว่างประเทศภายใต้สนธิสัญญาว่าด้วยความช่วยเหลือซึ่งกันและกันในเรื่องทางอาญาของภูมิภาคอาเซียน

สำหรับแนวทางการแก้ไขปัญหาดังกล่าวเพื่อความร่วมมือในระดับภูมิภาค บทความนี้มีข้อเสนอแนะว่า ควรจัดตั้งหน่วยปฏิบัติงานเฉพาะกิจและการตั้งศูนย์ประสานงานใน  4 ประเทศ และเป็นผู้ปฎิบัติงานในการให้ความช่วยเหลือระหว่างประเทศในคดีชาวต่างชาติที่ละเมิดทางเพศต่อเด็ก  ควรจัดทำบันทึกข้อตกลง ทางอาญาพหุภาคีระหว่างสี่ประเทศ เรื่องความร่วมมือระหว่างประเทศว่าด้วยการต่อต้านอาชญกรรมทางเพศต่อเด็ก  และจัดทำแผนปฏิบัติการร่วมกันในสี่ประเทศ  ควรจัดทำบันทึกข้อตกลงเพิ่มเติมความร่วมมือในการต่อต้านการล่วงละเมิดเด็กและการแสวงหาผลประโยชน์ผ่านการท่องเที่ยวในบันทึกความเข้าใจว่าด้วยความร่วมมือต่อต้านการค้ามนุษย์ใน อนุภูมิภาคลุ่มน้ำโขง รวมถึงควรจัดทำและพัฒนาฐานข้อมูลผู้กระทำผิดละเมิดทางเพศต่อเด็ก ทั้งระดับภายในประเทศและระหว่างประเทศ การจัดทำบัญชีดำผู้กระทำผิดและการติดตามตรวจสอบดูความเคลื่อนไหวของบุคคลในบัญชีรายชื่อนั้นด้วย

ABSTRACT

This article aim to study about the principles regarding the international cooperation on criminal issues in Thailand to combat the child sexual exploitation in travel and tourism in the Greater Mekong sub-region that focuses on Thailand, Cambodia, Laos PDR, Viet Nam. To study and propose a legal mechanism and other mechanisms for cooperation among the countries in preventing and combating child sexual exploitation in travel and tourism.

Owing to the study The Act on Mutual Assistance in Criminal Matters B.E. 2535 (1992) and Extradition Act B.E. 2551 (2008) we found problems with international cooperation on child sex cases the following: Lack of coordination between agencies and the slow process, High expenses when international travel is required, Legislation and implementation of laws on extradition, Lack of measures to enhance international cooperation under the ASEAN MLAT.

With regard to solving such problems for regional cooperation, the article has the guideline the following: Push for Establish a special task force and coordination center and focal point in the four project countries to enhance international cooperation against foreign child sex offenders, Push for Make multilateral international MOUs for cooperation to combat sexual crimes against children and develop a 4-country joint operation plan for cross-border cooperation at a region level, Push for Make additional MOUs for cooperation against child sexual abuse and child sexual exploitation in travel and tourism, as with the COMMIT MOU against human trafficking to enhance cooperation against foreign child sex offenders in the four project countries, Push for the design and development of a child sex offender database of national and international standards including make Black List and Watch List.
