Concept on the Acquisition of Thai Senator in the Past Decade

บทคัดย่อ 

การที่รัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช 2557 ได้กำหนดให้คณะกรรมการร่างรัฐธรรมนูญต้องจัดทําร่างรัฐธรรมนูญให้ครอบคลุมเรื่องการให้มีการปกครองระบอบประชาธิปไตยอันมีพระมหากษัตริย์ทรงเป็นประมุขที่เหมาะสมกับสภาพสังคมของไทยไว้ จึงสมควรได้ทบทวนแนวคิดเกี่ยวกับการได้มาซึ่งสมาชิกวุฒิสภาของไทยโดยผู้เขียนจะคัดเลือกมาเฉพาะบางเหตุการณ์ในช่วงทศวรรษที่ผ่านมา ซึ่งโดยแท้ที่จริงแล้ว หากเราสามารถตอบได้ว่าการมีวุฒิสภานั้นเป็นไปเพื่อวัตถุประสงค์ใด จะทำให้การกำหนดขอบอำนาจหน้าที่ ของสมาชิกวุฒิสภาชัดเจนขึ้น และนำไปสู่คำตอบว่า กระบวนการได้มาซึ่งสมาชิกวุฒิสภาที่เหมาะสมควรเป็นเช่นใด 

ABSTRACT

The Constitution of the Kingdom of Thailand (Interim Edition) of B.E. 2557indicates that the constitution drafting commission shall draw up the draft constitution to comprise the adoption of a democratic government with the King as Head of State which is suitable for the Thai social conditions. Therefore the conception of the acquisition of senators of Thailand should be reconsidered. The author is going to select some events over the last decade. As a matter of fact, as we could retort what the objectives of the adoption of the Senate are, the scope of the authority shall be defined clearer and it would come up with the answer about how the appropriate acquisition of the Senate should be.
